Overview

Todd helps clients build and maximize the value of their intellectual property portfolios through prosecution, licensing, and acquisition. Working with startup ventures, he creates portfolios that entice bidders and secure funding. For clients of all stages and sizes, he prepares and prosecutes patent, trademark, and copyright applications and prepares validity, freedom to operate, and noninfringement opinions in the United States and abroad. He is frequently sought out to perform intellectual property due diligence and to counsel on value creation. He also advises clients and acts on their behalf in reissue applications and reexamination proceedings before the U.S. Patent and Trademark office.

Todd has litigated before various federal courts and the International Trade Commission, including having taken and defended depositions, assisted in preparing expert opinions, drafted motions and oppositions, developed patent positions and strategies, and prepared trial exhibits.

He has been a speaker and author for numerous publications, including presenting and writing for Nano Boston on topics such as Intersecting Intellectual Property and Funding as well as Intellectual Property: Funding and Licensing Strategies for Nanotechnology Inventions. Todd's prolific technical publications have included topics such as microlens arrays, wavefront and control testing for standard and segmented optics, modeling and experimenting with transmissive phase plates, diffraction grating and filter results, and fiber optic fusion splicing.

Representative Matters

Among his many experiences counseling clients on value creation, Todd was involved in building the intellectual property portfolio of a radio company positioned as a digital solutions provider for the radio broadcast industry. The company was engaged in connecting advertisers directly to radio stations through an automated scheduling platform designed to simplify sales, scheduling, delivery, and reporting, and was focused on becoming acquired by a company invested in Internet search, cloud computing, and advertising technologies. After working for several years developing intellectual property for the company, Todd was involved in its sale to a targeted acquirer.

Previous Work and Industry Experience

Prior to entering his career in law, Todd was an engineer at Swales, an employee-owned government contractor, primarily working on projects for NASA. At Swales, Todd developed a phase retrieval algorithm used in data reduction and programmed and designed software to transform system outputs. He also installed and aligned flight optics in instruments and was involved in optical metrology and component testing.

Life Beyond Law

Todd enjoys spending time with his family. This time often revolves around his kids’ sports and other activities, bike rides, kayaking, trips to the shore, and college and NFL football.
